The family of one of the victims killed in a fiery car crash in Los Angeles last year has filed a lawsuit against Nicole Linton, a traveling nurse from Houston who is facing murder charges in connection to the incident. The lawsuit alleges that Linton exhibited troubling behavior prior to the incident and that the defendants, including the company she worked for, should never have hired such a manic person. The family claims that Linton’s past arrests, manic episodes, and crashes should have been red flags for the defendants, and they should have taken action to prevent this tragedy from the start.

Linton’s car collided with multiple vehicles back in August, resulting in the deaths of six people. In addition to murder charges, she is also facing charges of gross vehicular manslaughter, though Linton’s lawyers argue that she had a psychotic break moments before she sped through the intersection, suggesting that her mental state played a significant role in the incident.

“Defendants, and each of them, should have never hired Nicole Lorraine Linton, and/or should have immediately reported her troubling behavior to the California Board of Nursing and should have taken other actions to protect the public from the foreseeable dangers she posed to the citizens of Los Angeles, California while working for the West Los Angeles Kaiser Medical Center,” the court docs reveal, per Law & Crime. 

Another family had previously filed a similar lawsuit, further highlighting the gravity of Linton’s actions and the clear need for accountability. Linton has pleaded not guilty to the charges and is currently in jail awaiting trial. 

The family is demanding a trial by jury and seeking unspecified damages as they seek justice for their lost loved one.

The lawsuit also brings into question the responsibility of Linton’s employers, AMN Healthcare Services and Kaiser. The plaintiffs argue that these companies should be held accountable for negligent hiring, training, and supervision.

They allege that Linton’s employers ignored the risks associated with employing someone with a history of mental health issues and previous psychotic episodes. The defense denies allegations of prior accidents, DUIs, or substance abuse on Linton’s part.
