Kim Zolciak and Kroy’s $3 Mil Home in Pre-Foreclosure Again

Kim Zolciak and Kroy Biermann‘s $3 million Georgia mansion has gone into pre-foreclosure.

As the Real Housewives of Atlanta couple faces the possible loss of their home for the second time this year, with a pending sale date set for November, Kroy, 38, is accusing his estranged wife, 45, of being “abusive” toward him in front of their four children.

In court documents filed last week and obtained by Us Weekly, Kroy claims Kim has spent “little time at home” with their kids, who include Kroy “KJ” Jr., 12, Kash, 11, and nine-year-old twins Kaia and Kane, and she “frequently takes videos of herself” in the car as she drives with them.

Due to his concerns, Kroy says a guardian ad litem is in their “best interest and welfare” and has suggested family law attorney Diane Woods act as his kids’ guardian throughout his and Kim’s divorce.

In a statement, Kroy’s lawyer, Marlys A. Bergstrom, said Diane will serve as “an attorney for the children and as the eyes and ears of the court.”

“[The guardian] can do whatever investigation she feels necessary to help the court determine what custodial arrangement is in the best interest of the children,” the attorney said. “Ms. Diane Woods is a very experienced and well-respected Guardian Ad Litem.”

In Kroy’s documents, he went on to explain that the request for Diane was made to “shield the children from the negative fallout of their parents’ divorce” and that Kim has continued to “direct, in a derogatory tone, abusive, profane and threat-laden language [toward him] with little concern if the children are present.”

He also said she wants to reclaim her role on RHOA, which is concerning to him.

“Based on previous experience, [Kroy] is concerned that [Kim] will use the television show to garner attention by discussing the divorce and exposing the children to behavior that would be great for TV ratings, but not for the mental health and wellbeing of the children,” the documents stated.

In other news, as online records obtained by TMZ on September 15 show, Kim and Kroy’s home is in pre-foreclosure with a pending sale date of November 7. Although the property isn’t officially in foreclosure quite yet, it is headed in that direction, likely due to missed mortgage payments.

As fans will recall, Kroy requested an emergency hearing to approve the sale of the mansion in August, stating that the proceeds could cover their “significant debt.”

In recent weeks, Kroy has been selling his belongings in an effort to make his and Kim’s mortgage payments, but despite selling her own things, including bags and purses, Kim has reportedly refused to contribute.

“None of the funds garnered from the sale of these items have gone towards the mortgage, or any other bills,” he wrote in court documents.

As Kroy hopes to unload the property, his attorney told TMZ, “We are going to court on September 27th to request that the court order the home sold.”
