Kim Zolciak wants to remain married to Kroy Biermann despite their volatile marriage and his second divorce filing.
In newly uncovered court filings, Kim is asking a judge to dismiss Kroy’s request for a divorce as she claims they are still having a ton of sex as they continue to live together as man and wife.
According to Page Six, the Real Housewives of Atlanta star responded to the former NFL player’s most recent divorce filing by stating they’ve had “marital sexual relations on multiple occasions” since he filed.
In addition, Kim, 45, feels that the fact that she and Kroy continue to live together under one roof is proof that his claim of their marriage being “irretrievably broken” is “demonstrably false.”
TMZ is also reporting that Kim gets quite specific in her court filing, listing September 7 as the last time they were intimate.
Kroy, 38, filed for divorce for a second time on August 24 as he has blamed Kim’s gambling problems for making them financially destitute, even claiming she has gambled away $1.5 million.
The $3 million Georga mansion of the Don’t Be Tardy alums has also gone into pre-foreclosure again and is now slated for auction on November 7.
Recently, Kroy asked for an emergency hearing as he hoped a judge would quickly approve the sale of the mansion, stating that the proceeds from the sale could cover their “significant debt.”

In recent weeks, Kroy has been selling his belongings in an effort to make his and Kim’s mortgage payments. And while Kim has also been selling her own things, including bags and purses, she has reportedly refused to contribute to the family’s financial needs.
“None of the funds garnered from the sale of these items have gone towards the mortgage, or any other bills,” Kroy claimed in court documents.
Amid Kroy’s hopes of unloading the property, his attorney told TMZ, “We are going to court on September 27th to request that the court order the home sold.”
Kroy’s attorney also stated earlier this month that despite Kim’s hopes of staying married, Kroy is moving forward with the divorce.
“I spoke with Kroy regarding the ‘reconciliation’ Kim announced over the weekend,” said Marlys A. Bergstrom to Us Weekly on September 11. “There is no reconciliation, his resolve to see this divorce through to the end has not waivered.”
