Kroy Biermann fires back at Kim Zolciak’s attempt to get their divorce dismissed and denies he wants to reconcile despite them still having sex.
According to court documents obtained by TMZ, Kim Zolciak is demanding that Kroy Biermann’s latest divorce petition be tossed out because they are still having tons of sex with each other.
In the petition — filed on Monday, September 25, Kim claims that she has repeatedly banged her estranged husband since he filed for divorce from her for the second time in August.
The Real Housewives of Atlanta OG says she and the former NFL star hooked up as recently as September 7. She adds that Kroy Biermann‘s claim that their marriage is “irretrievably broken” is bogus. Kim says if their marriage was really broken, they wouldn’t be still sleeping together.
The 45-year-old also points out that she and Kroy continue to live under the same roof, which further proves that their marriage isn’t “irretrievably broken.”
While Kim is still wearing her wedding ring and is trying to get their divorce dismissed, Kroy is making it clear that he doesn’t feel the same.
In response to Kim’s court filing, the 37-year-old stated that he has “no desire to reconcile” with his estranged wife, per Us Weekly.
“The fact that he engaged in sexual relations with [Zolciak-Biermann] does not indicate a desire to reconcile,” Kroy’s court documents state. “[Biermann], after this second filing, remains steadfast in his desire to leave [Zolciak-Biermann], leave the marital residence, with the children, and provide a home for them that is calm and stable, the opposite of their current environment.”
Kroy also accuses Kim of attempting to delay their divorce with her petition as she does not want to move out of their Georgia home, which is set to be foreclosed on in November.
“She has stated that she prefers to file for bankruptcy, a move that will ensure that the parties and their children will remain under the same roof for a significant period of time,” the court docs read. “Without the receipt of equity from the sale of the marital residence, the parties cannot afford to move out of the residence and into new residences.”
The Real Housewives of Atlanta is expected to return for season 16 in 2024.
