RHOBH star Erika Jayne is being accused of “bleeding” Tom Girardi’s estate dry amid her ongoing fight for a pair of diamond earrings taken from her.
Erika Jayne won’t stop fighting for what she believes is rightfully hers. The RHOBH star refuses to drop her fight over a pair of diamond earrings taken from her as part of her estranged husband Tom Girardi’s bankruptcy case.
Now, per Radar Online, Erika is being accused of causing “economic bleeding” to Tom Girardi’s estate, which owes millions to his former clients turned victims.
In a recent court filing, the trustee overseeing Tom Girardi‘s bankruptcy case said she’s over the RHOBH star’s attempts to drag out the case for the pair of $750k diamond earrings. According to the trustee, there is no question that the funds Tom used to buy those diamond earrings were meant for his clients and not for his personal use.
The trustee has the court to shut down the RHOBH star’s legal fight once and for all. She believes that the court needs to “most importantly stop the economic bleeding Erika is causing the estate in pursuit of her quest to benefit from the unconscionable fraud and crime perpetrated by her husband.”
Per the trustee, Erika recently requested more time to review additional discovery, including interviewing the trustee’s expert witnesses. However, the trustee says that Erika has provided no evidence to warrant the court granting her motion.
As a result, the trustee asked that the RHOBH star be stopped from continuing her unfounded legal battle.
Meanwhile, last month, the trustee accused Erika and her PR team of spreading false information in the press about her court battle for her $750k diamond earrings that were auctioned off last December for $250k as part of Tom Girardi’s ongoing bankruptcy case. The once-famed attorney is accused of embezzling millions from his clients via their settlement money.
The Pretty Mess singer appealed the auction, claiming that the earrings were taken from her unlawfully. In July 2023, multiple outlets reported that Erika Jayne had won her appeal over the earrings. It is believed that Erika would get the proceeds from the diamond earrings, but that remains unclear amid the trustee’s latest filing.
“Erika has falsely allowed her PR team to suggest she won the appeal and has gone so far as to suggest she is entitled to the proceeds from the sale,” the trustee said. “As the Court knows and the District Court affirmed, the buyer of the earrings has no further exposure as a result of the sale. The auctioneer and other professionals have already been paid for the work related to the sale. The proceeds of the sale under any scenario are not Erika’s. They are the clients whose funds were misappropriated.”
The trustee added, “The money used to purchase the Earrings is either Estate property or the clients’ property, but it is not Erika’s property under any scenario. This undisputed finding by this Court and the District Court precludes Erika from any claim to the proceeds from the sale of the Earrings. She cannot profit from her husband’s theft of his clients’ money and that should be cleared up in any order or finding by this Court.”
The trustee also asked that Erika not be awarded damages, explaining that the proceeds from the auction can NOT revert to the RHOBH star.
“The District Court affirmed the Trustee’s position that regardless of whether the money was commingled and therefore the Earrings were property of the Estate, or the property of the beneficiaries of the trust account, Erika, as the recipient of the fruits of the money stolen from the trust account, does not have any right or interest in the Earrings or the proceeds of the sale thereof.”
The trustee continued, “The District Court’s order implicitly indicated that these funds either belong to specifically identifiable clients or the Estate and should be administered by the Trustee. In all events, Erika no longer has a “dog in this fight.”
