Diddy has filed a motion to dismiss one of his sexual assault lawsuits, particularly the one filed by a Jane Doe, as he claims the woman cannot put an exact time or place on the alleged incident and that the statute of limitations has expired.

According to the filing, obtained by TMZ, attorneys for Diddy, born Sean Combs, want a judge to dismiss the sexual assault case, filed by Jane Doe, with prejudice. In the lawsuit, Doe alleges she was violated by Diddy and his associates at the age of 17 back in 2003.
Diddy’s attorneys insist that Jane Doe’s sexual assault lawsuit has not only passed the statute of limitations to be filed and tried, but more importantly, Doe has not provided important details outside of her alleged assault, like the exact time or place it allegedly happened. The mogul’s attorneys believe the case is not worthy of being heard for those two reasons as well as the fact that Diddy affirms the allegations are false and the alleged incident never even happened.

Diddy’s attorneys also argue that Jane Doe issued a “trigger warning” on her original sexual assault lawsuit, which is something they believe was done in an attempt to conjure up some attention and public interest to the salacious nature of her claims, which Diddy’s attorneys claim have no merit whatsoever.
Per TMZ, the mogul’s attorneys wrote, “The sparse amendments to the original Complaint cannot remedy the falsehoods and incurable defects in the new pleading. Like the original Complaint, it fails to state any viable claim and must be dismissed.”
They added, “Plaintiff cannot allege what day or time of year the alleged incident occurred, yet purports to miraculously recall the most prurient details with specificity. Accordingly, this case should be dismissed now, with prejudice, to protect the Combs Defendants from further reputational injury and before more party and judicial resources are squandered.”

Before Diddy’s motion to dismiss due to the statute of limitations and more, Jane Doe filed her sexual assault lawsuit against the mogul in December 2023, shortly after the mogul settled his $30 million rape, abuse, and sex trafficking lawsuit with ex-girlfriend Cassie. Doe also claimed that she too was allegedly sex trafficked, drugged, and gang raped by the mogul and associates when she was 17 in 2003. One of those alleged associates named was former president of Diddy’s Bad Boy Entertainment record label, Harve Pierre.
Doe alleged that she met Pierre at a nightclub in Detroit, Michigan, where he allegedly told her she was “hot” and that Diddy would love to meet her. Pierre allegedly called the mogul and put Doe on the phone, where he allegedly told her she should fly to New York City with Pierre to meet him.
Doe agreed, however, she alleged that she was forced to give Pierre, who had been allegedly smoking crack cocaine, oral sex before they boarded the flight. Upon landing, Doe alleged that she was taken to Diddy’s recording studio, where she was allegedly plied with alcohol and drugs by Diddy, Pierre, and a third assailant, who had flown with her and Pierre.

Doe’s lawsuit alleged, “While at the studio, Ms. Doe was gang raped by Mr. Combs, the Third Assailant and Mr. Pierre, in that order.” She claimed Diddy removed her underwear and forced himself on her as she “hung over” a bathroom sink. He then allegedly “watched on as Third Assailant, who Ms. Doe had not even realized had begun to have sex with her, raped Ms. Doe as she told him to stop.”
It’s further alleged that Pierre “took his turn at raping Ms. Doe and then violently forced her to give him oral sex, during which Ms. Doe was choking and struggling to breathe” and soon “fell into the fetal position” as her “vagina was in pain.” She claimed she could “barely stand up” after the alleged gang rape and that she was helped into a car that took her back to the airport.
Doe claimed she has “limited” recollection of getting back to Michigan, however, her lawsuit included various photos that were “taken in the studio that night, leaving no doubt that Ms. Doe was in Mr. Combs’ New York City studio, with Mr. Combs, on the night she was raped.”
