Jax Taylor breaks his silence after giving his estranged wife “full custody” of their son Cruz in an erroneous court filing.
In court documents filed last month in the Superior Court of California in Los Angeles County, Jax Taylor represented himself when requesting the court dissolve his marriage to his estranged wife, Brittany Cartwright.
The 45-year-old Vanderpump Rules OG suggested in his filing that he and Brittany “were never legally married.” According to the court documents, Jax Taylor also gave Brittany “full physical and legal custody of their son.”
In his request for a dissolution of marriage, Jax noted that he and Brittany had been married for four years and six months before separating in January of 2024. He also checked the box suggesting they “never legally married.”

The Valley star listed his and Brittany’s only asset as their $1.9 million home and requested that the property be divided at a later date.
Brittany responded to the claims made in Jax’s filing on social media, commenting: “We are legally married. I’m guessing paperwork is hard for some people.”
Now, Jax’s rep is speaking out on his and Brittany’s custody arrangement and the “errors” made in his court filing.
“Jax and Brittany have already long resolved all matters related to Cruz’s custody and will continue to work together privately for the best interest of their son, which remains their overriding concern. While Jax made errors in filing out forms that are usually done by trained legal professionals, those errors will be amended without delay,” Jax’s rep said in an October 2 statement to PEOPLE.
On October 4th, Jax Taylor refiled for divorce from Brittany after hiring attorney Mark Vincent Kaplan, who represented Kevin Federline in his divorce from Britney Spears.
Jax Taylor’s September 26 filing comes a month after Brittany filed for divorce on August 27. In her filing, she requested full physical and legal custody of Cruz.
“This step has been a long time coming and something Brittany knew she had to do for the best interest of herself and her son in order to move forward and put a stop to this tumultuous cycle they’ve been living in,” a source told PEOPLE at the time of Brittany’s filing. “Jax is feeling mixed emotions. He knows this is ultimately the right decision but is sad that things ended up the way they have. It’s an emotional month for him, and he’s trying to stay strong for his son.”
“Their main priority is getting to a place of being amicable co-parents for their son, and this next stop will hopefully move them closer to that goal,” the insider added.
Since splitting earlier this year, Jax and Brittany have publicly boasted about the others’ parenting skills.
“I will always love and care for Brittany. She’s the mother of my beautiful son. All I want for us is to be amicable co-parents, and even hopefully, really, really good friends one day,” Jax said on his and Brittany’s podcast When Reality Hits. “I know I’m an amazing father and I know that I will make an excellent ex-husband.”
On the other hand, Brittany told PEOPLE that Jax is a “great dad.”
“I’m not ever going to take Cruz away from him. We will always put Cruz first and we are going to work towards a healthy co-parenting relationship. It’s going to take some time,” she shared. “Still, things are very raw between us, but for the most part, I do know if I needed something, if Cruz needed something, I could call him and he would be there for us.”
The highly anticipated second season of They Valley wrapped filming earlier this summer and is expected to premiere on Bravo in late 2024 or 2025.
