According to Foster’s divorce filing, he and Prepon separated on September 9, 2023. He claimed the pair were “unable to live together successfully as husband and wife” and asked the court to terminate their marriage.
Foster also requested the enforcement of a 2018 prenuptial agreement. The actor and Prepon have known each other since their teenage years, but things did not turn romantic until 2016, per In Touch.
At the time, a source claimed they were seen “making out” over dinner in New York City. The pair were also seen celebrating the 4th of July together in New Jersey, with an eyewitness telling US Magazine:

Following the Supreme Court’s decision to overturn Roe vs. Wade in 2022, The Blast shared that Prepon was among the celebrities against it. She used her abortion story to raise awareness about the importance of this right to women.
“One of the worst days of my life was when I made the choice to terminate a pregnancy in the second trimester,” Prepon wrote on Instagram, adding:
“The devastating truth is that we found out the fetus would not survive to full term and that my life was at risk as well.”
