After previously being denied the possibility to dismiss his Jane Doe sexual assault case with Diddy, JAY-Z has now been granted permission to file for a motion for dismissal, according to court records obtained by legal reporter Meghann Cuniff.

On Thursday (January 2), Cuniff reported that U.S. District Court Judge Analisa Torres granted JAY-Z’s lawyer Alex Spiro’s request to file a dismissal motion in the amended lawsuit that accuses Hov, born Shawn Carter, and Diddy, born Sean Combs, of raping a 13-year-old girl in 2000. Cuniff noted that Torres’ permission arrived over the objection of Jane Doe’s lawyer, Texas attorney Tony Buzbee.
According to the court documents, Judge Torres has given JAY-Z and his legal team until February 6 to file their dismissal motion in the Jane Doe sexual assault case with Diddy. Jane Doe and her lawyer Tony Buzbee have until February 28 to file their opposition paperwork, and by March 14, JAY-Z and his legal time must reply, if they choose to do so.

Cuniff further noted that in his request to file a dismissal motion, filed on December 30, JAY-Z’s lawyer previewed some of his arguments against Jane Doe’s allegations. Spiro included a Statute of Limitations claim and also said Doe’s Victims of Gender-Motivated Violence Protection Act claim does not have a retroactive effect.
Another argument was made regarding the location of the alleged sexual assault, with JAY-Z’s lawyer claiming it was outside of New York City, further attacking the accuser’s claims and credibility.

Cuniff further reported that Jane Doe’s attorney, Tony Buzbee, opposed the filing of a dismissal motion in a New Year’s Eve letter, two days before the judge granted JAY-Z permission to file a dismissal motion. In his filing, Buzbee responded to JAY-Z and his attorney Alex Spiro’s December 30 letter, which marked their latest attempt to request to file a dismissal motion.
Buzbee fired back at Spiro’s arguments about Doe’s Victims of Gender-Motivated Violence Protection Act claim not having a retroactive effect, providing supporting cases. And did the same for Spiro’s arguments about the Statute of Limitations and the alleged incident not occurring within the limits of New York City.
Despite Buzbee’s attempt to prevent the judge from granting Spiro’s request to file a dismissal motion in his Jane Doe sexual assault case with Diddy, JAY-Z has now been granted to file to dismiss the case against him.
