Erika Jayne is headed to trial early next year after being accused of spending more than $25 million in funds meant for the innocent victims of her former spouse.
Weeks after her estranged husband, Thomas Girardi, 86, was sentenced to over seven years in prison for stealing millions from his former law firm clients, an update in his bankruptcy trustee‘s case against the 54-year-old Real Housewives of Beverly Hills star has been shared.
“Big update on the long awaited fraudulent conveyance trial against Erika Girardi,” attorney Ronald Richards began in a July 13 post on Instagram. “Here is what is hopefully the final joint report to set the now February 26, 2026 trial against Erika Girardi. We filed our fraudulent conveyance action four years ago tomorrow. What a ride it has been. Avoid, delay, and obfuscate has been the tactic of choice. We are here because [Erika Jayne] is not paying her legal fees and Girardi’s don’t settle. Erika is still married to Tom and the conventional pressures of a trial and the cost do not phase her.”
In newly filed court documents shared by Ronald, it was noted that the trustee, Elissa D. Miller, was seeking to recover the $25,592,26.26 that Thomas’ now-defunct law firm, Girardi Keese, is believed to have given Erika, via her company, EJ Global, over the course of several years, between 2008 and 2020, rather than paying its clients their settlements.
“All of the payments at issue were accounted for on the Mr. Girardi’s books and records as an intercompany debt ‘due from’ EJ Global, which the Trustee alleges is Erika’s alter-ego,” Ronald explained. “The company has done nothing for years and the Franchise Tax Board of California also found it was not a real business.”
According to Ronald, Erika’s defense is that she had nothing to do with how the firm booked the money to her company.
“We agree with her on that. However, she was the beneficiary of all of those payments and gave nothing in return for them and that is the essence of a fraudulent conveyance action,” he added.
Ronald also shared the news of Erika’s upcoming trial on X, along with a copy of the recent court filing in regard to her case.
In the attached document, it was noted that there was a joint status conference set for July 30, a final pretrial conference scheduled for January 28, 2026, and a trial set to begin on February 17, 2026, which is expected to last between seven to 10 days.
The Real Housewives of Beverly Hills season 15 is currently in production and expected to begin airing on Bravo sometime later this year or early next year.
