Alec Baldwin might be recharged with involuntary manslaughter after prosecutors in New Mexico seek to file charges again.

Baldwin could face 18 months in prison if convicted for the shooting. As previously reported, Hutchins was fatally shot on the set of Rust in October 2021, and Baldwin stated that he was unaware there were live rounds in the prop gun. Director Joel Souza was injured during the shooting but released from the hospital hours later. Although his two charges of involuntary manslaughter were dropped, prosecutors said there could be a chance that the charges could be refiled.

“It is unfortunate that a terrible tragedy has been turned into this misguided prosecution. We will answer any charges in court,” said Baldwin’s lawyers Luke Nikas and Alex Spiro.

Months after the initial investigation, Baldwin and Souza returned to set to complete the film, which moved production from New Mexico to Montana. Still, it is still being determined when the finished film will be released.

Halyna Hutchins was a Ukrainian-American cinematographer who worked on over 30 feature-length films, short films, and TV miniseries, including Archenemy, Darlin’, and Blindfire. Hutchins was born in Horodets, Ukrainian SSR, in 1979 and grew up on a Soviet military base in the Arctic Circle. She developed a love of film early on, and after graduating from Kyiv National University in Ukraine, she worked as an investigative journalist with British documentary productions in Europe.

In 2010, Hutchins moved to the United States to pursue a career in cinematography. She studied at the UCLA School of Theater, Film, and Television before graduating from the AFI Conservatory in 2015.

In addition to her work as a cinematographer, Hutchins was also a wife and mother. She is survived by her husband, Matthew Hutchins, and their son, Andros.
