According to a new policy alert released by the U.S. Citizenship and Immigration Services (USCIS) via the U.S. Department of Homeland Security, immigration forms will be adding a new gender option to now allow migrants to identify as “X.”

Although released on Monday, April 1, 2024 (April Fool’s Day), it’s no joke! In their release, the U.S. Citizenship and Immigration Services stated that it will be revising its policy guidance in the USCIS Policy Manual “to clarify the availability of an ‘X’ gender marker option on certain USCIS forms and secure documents.”
In the past, USCIS forms and associated secure documents only allowed migrants to choose between two gender options: “Male (M)” or “Female (F).” USCIS stated that because the immigration forms only offered two options in the past, it created “significant barriers for those requestors.”

USCIS further explained, “Limiting benefit requestors to binary gender options also creates administrative challenges for USCIS, where benefit requestors submit birth certificates and other official government-issued documents with a gender other than ‘M’ or ‘F.’”
Therefore, the U.S. Citizenship and Immigration Services is now introducing an additional, third gender option, which they are dubbing “X,” as it is “consistent with other federal and state agencies that have introduced a third gender option.”

Additionally, USCIS states, “After considering feedback from benefit requestors, the public, and the Centers for Disease Control and Prevention’s National Center for Health Statistics’ recommendations, USCIS has determined that it will define “X” as “Another Gender Identity” for purposes of USCIS forms and secure identity documents.”
According to USCIS’ policy alert, the additional gender option “X” will become available upon each form’s revision, beginning with the Application for Naturalization (Form N-400). USCIS adds, “Applicants who have a pending Form N-400 using the edition in effect before April 1, 2024, may request to update their gender on or after April 1, 2024, as well. For all other forms, individuals must wait until USCIS revises those forms to include the X gender option.”

Furthermore, USCIS notes that if you do choose to select “X” as a gender option on the new Form N-400, applicants may need to visit a Social Security office for a Social Security card or to update their citizenship status, as the Social Security Administration is still developing their own systems to accept the “X” gender option.
USCIS also states that applicants do not need to provide any supporting documentation to select “X” as their gender initially or to change their gender selection for Form N-400. They note that by selecting “X” as a gender, it does not need to match the gender listed on their other immigration documents or on supporting identity documents, like birth certificates, passports, or state identification cards.
