Judge Scolds Kim Zolciak for Skipping Divorce Hearing

Kim Zolciak skipped a divorce hearing on Wednesday, leaving the judge on hand annoyed and frustrated — and leaving estranged husband Kroy Biermann to answer questions about the impending foreclosure of their $3 million home.

As Kroy, 38, was asked about the foreclosure and about the equity he and Kim have in their mansion, Kim, 45, formerly of Real Housewives of Atlanta and Don’t Be Tardy, was absent. This was reportedly due to her recent trip to Colombia, where she spent weeks filming MTV’s The Surreal Life.

On September 27, TMZ revealed Kim was flying back to Atlanta on Wednesday. And shortly after landing, Kim confirmed she was back home with a post on her Instagram Story.

Along with a repost from daughter Brielle Biermann, 26, which said they had “many things to celebrate tonight,” Kim said she was glad to be back.

“God is so good! Happy to be home,” Kim wrote.

According to TMZ, Kim and Kroy will continue cohabiting at their Georgia home, mainly because they don’t have any other options.

As RHOA fans may have heard, Kim is currently trying to have her divorce from Kroy dismissed, claiming their active sex life with one another is proof of a reconciliation. However, according to Kroy, their “sexual relations” are not a sign that they are back on.

As for Kim’s skipped hearing, which was set to take place on Zoom, a September 27 report from Entertainment Tonight revealed that Fulton County Superior Court Judge Shermela J. Williams called it a “waste.”

All other parties were present for the divorce hearing, including Kim’s lawyer, David Beaudry, who explained that she was on a flight back from Colombia and not expected to land until 9 p.m. on Wednesday and apologized on her behalf.

Still, the judge was “visibly irritated” and “annoyed.”

“Her presence was not waived for today, so she is supposed to be here. I did not waive her presence,” she stated, eventually agreeing to reschedule the hearing — without the benefit of Zoom.

Kroy and his lawyer, Marlys Bergstrom, also spoke during the hearing, addressing the emergency motion he filed in an effort to sell his and Kim’s home, which will be foreclosed upon on November 7.

“Correct,” Kroy replied when asked about the impending date.

Then, when Kim’s attorney was questioned about the foreclosure, he said, “I did not know that.”

While Kroy refused to disclose their home’s approximate equity, citing media coverage, he did reveal that the equity exceeds $1 million.

“Correct,” he stated.

Kim and Kroy are expected to appear in court on September 29 to address Kim’s request to dismiss their divorce and Kroy’s petition to sell their home.

The Surreal Life season eight is expected to premiere on MTV sometime next year.
